Elmer Cotton Oxford - Terms and Conditions.
0. DEFINITIONS Seller means Elmer Cotton Oxford, 18/19 Turl Street, Oxford, OX1 3DH, and the company's web site http://www.elmercottonoxford.com. Customer means the person or company to whom this document is addressed.
International Customer shall mean Customer from outside the UK.
1. GENERAL These terms and conditions are applicable to the supply of products supplied by the Seller, hereafter referred as Elmer Cotton Oxford, the buyer hereafter referred to as the Customer.
2. PRICE All prices are quoted in pounds sterling and are shown inclusive of VAT.

3. PAYMENT Payment must be made in pounds sterling only, unless by special agreement, or by one of the following payment methods.
All Major credit cards accepted. Cheques and Postal Orders made payable to Elmer Cotton Oxford. Bank transfers to our bankers, details available on request.
4. PASSING OF PROPERTY Elmer Cotton Oxford shall retain the property of the goods until the customer has made full and authorised payment.
5. PASSING OF RISK The risk in the goods shall pass to the Customer on delivery, as defined in clause 6.3 below.
6. DELIVERY 6.1 Delivery date: Any date or period for delivery shall be considered as indicative only, although it is our policy to fulfil all orders within 14 days. You will be advised as to delivery time of any products not available at the time of your order. All products will be sent to you, as soon as possible, when received from the manufacturer. Elmer Cotton Oxford cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. Any costs incurred for the supply of the product, i.e. storage, duty, taxes will be the responsibility of the customer. If we are unable to arrange delivery to the customer as agreed on date of purchase, the customer will be given the opportunity to cancel the order as defined in clause 9. Elmer Cotton Oxford will always liase with the customer to arrange a mutually convenient delivery time for bulky items.
6.2 Shipping: All products are sent through a major delivery company. Where products are shipped "recorded delivery" they must be signed for. The Customer may request other delivery methods at the time of the order, the goods will then be shipped and the Customer will be responsible as defined in clause 6.3.
6.3 Passing of risk: Customer is responsible for those goods, once the goods have been despatched from the supplier, or Elmer Cotton Oxford premises.
7. ACCEPTANCE The Customer should inform Elmer Cotton Oxford within a period of ten days if the goods are not acceptable. If no such action is taken, Elmer Cotton Oxford will consider the products to be of a satisfactory quality and fit for their intended purpose. This does not affect your statutory rights as a customer.
8. RETURN PROCEDURE 8.1 If the goods are to be rejected in the time limit set in clause 7 above, the Customer shall comply with the return procedure as defined in clause 8.2, below. Elmer Cotton Oxford will not accept any returned goods should the return not follow the aforementioned return procedure.
8.2 The Customer must contact Elmer Cotton Oxford, Customer Services on 01865 241010, and obtain a Returns Authorisation Number (RAN). This number shall be clearly quoted on the returned package, and the package must be returned within 7 working days of obtaining the RAN to the following address:

8.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to Elmer Cotton Oxford before the refund or replacement can be issued.
8.4 In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a partial refund (full refund less postage) only. Goods must be returned to Elmer Cotton Oxford before the partial refund can be issued.
9. CANCELLATIONS 9.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been dispatched. If the order has been dispatched prior to the cancellation, the return procedure as defined in clause 8 (8.2 and 8.4) above will apply. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for the full payment.
9.2 Cancellations can be made with Elmer Cotton Oxford, 01865 241010. Customers will be provided with a Cancellation Reference number (CRN) for them to keep for future reference.
10. INTERNATIONAL CUSTOMER Customers from outside the UK can only pay by International credit card or bank transfer and must pay in pounds sterling unless otherwise specified. All other terms and conditions apply.
11. COMPLAINTS All complaints will be dealt with within 5 working days and should be addressed to the Sales Director who will personally handle the complaint.
12. PRIVACY POLICY Information is collected lawfully and in accordance with the Data Protection Act 1998 through the ordering/registration process or through e-mail enquiries. This is used to maintain customer relations and advise customers of news that may be of interest to them. We further undertake not to disclose these details to any third party without the express and specific consent of the customer.
13. LAW These terms and conditions are governed and shall be interpreted in accordance with English law.
